2. Applicability

These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

3. Offer and Product Information

  • All products are described and presented as accurately as possible.
  • Products offered may be new or pre-loved (used).
  • Visible signs of use will be stated for used products.
  • Minor deviations in color, weight, or sound (e.g., with cymbals) are product-specific characteristics and do not constitute a defect.

4. Prices

  • All prices are stated in euros.
  • Prices include VAT unless stated otherwise (e.g., margin scheme).
  • Shipping costs are stated separately.
  • Obvious errors or mistakes in pricing are not binding.

5. Formation of the Agreement

The agreement is concluded at the moment the consumer accepts the offer and complies with the stated conditions.

6. Payment

Payment can be made via all offered payment methods.

Orders will only be shipped after full payment has been received.

7. Delivery and Shipping

  • Delivery takes place at the address provided by the consumer.
  • Orders are generally shipped within 1–3 working days.
  • Shipping is insured and carefully packaged.
  • Risk transfers to the consumer once the product has been delivered.

8. Right of Withdrawal (Returns Policy)

For consumer purchases:

  • The consumer has the right to cancel the order up to 14 days after receipt.
  • After cancellation, the consumer has an additional 14 days to return the product.
  • The full order amount (excluding shipping costs) will be refunded.

Return conditions:

  • The product must be in its original condition
  • No damage or additional signs of use
  • Properly packaged for return

Exceptions:

  • Custom-made or personalized products
  • Products that cannot be returned for hygiene reasons
  • Business purchases (B2B)

Return shipping costs are borne by the buyer.

9. Warranty and Conformity

  • Products must meet what the consumer may reasonably expect.
  • New products are covered by the manufacturer’s warranty.
  • Used (pre-loved) products have a limited warranty for hidden defects.

Normal wear and tear (such as drumheads, sticks, or cymbal wear) is not covered under warranty.

10. Liability

  • The entrepreneur is not liable for indirect damages.
  • Liability is limited to the purchase amount of the product.
  • Use of musical instruments is at your own risk.

11. Complaints Procedure

The entrepreneur will respond within 14 days.

12. Disputes

All agreements are exclusively governed by Dutch law.
Disputes may be submitted to the competent court.

13. Additional Provisions (specific to musical instruments)

  • Cymbals have natural variations in sound and weight
  • Vintage instruments may have age-related characteristics
  • Sound experience is subjective and not in itself grounds for return
  • Tuning and setup differences are part of normal use

14. Amendments to the Terms

The entrepreneur reserves the right to amend these terms and conditions.
